Shared Patio Space

Does anyone know if a customer could bring a cocktail from the cocktail room to a shared patio space? All 3 tenants, including a restaurant and brewery would be paying for that square footage of the patio space in the lease agreement. Distillery production and cocktail room space would be exclusive to the distillery. Thanks!

I think this question would be specific to your state laws and not Federal/TTB.   The TTB would not have an issue as long as the cocktail room space and the shared patio space are not part of yours or the breweries bonded premise.

Check local laws on sidewalk or outdoor cafe service of alcohol. Since this is "shared" space, it sounds like it would be considered "public" space, and may not be covered by your regular liquor permits for service by default. It also matters if it is an area where customers can bring purchased cocktails, or if you plan to serve in the space. Then look to see if your state permit will allows the local permits required.

Thanks for the suggestions blue star. What it is essentially is a dock loading area that will be partitioned off for a "patio" and accessible to all tenants and their customers. We would be paying for that square footage, but not serving on that square footage. It would be purchased cocktails brought from the distillery to that portion by the customer.

In that case, it is likely the local body that matters, talk with them.
