Distilling of Tribal Indian Land

I have been approached by an investor that is a member of an indian nation. They want us to open a distillery on tribal land, and distribute to indian casino's.

Does anyone know if we will still be bound by federal and state regulations even though indian territories are sovereign nations?

Technically no, but even for an Indian nation to open a casino there is a local & federal process they go through. Even though a lot of it seems to be a courtesy on the part of the particular tribe. This only applies to reservation areas in the lower 48. In Alaska Native lands all came via the State, not the feds, so ttb would still apply there. You might start by talking with the ttb, or a lawyer specializing in Native American Tribal issues. Keep us posted, as this is a very interest subject, and there are also many tribal casinos in my region.

Having worked with the tribes and state agencies on projects (fisheries) I could not imagine how slow they would move on this. I get frustrated with tribal time a lot and that's on things that my life ($$) doesn't realy depend on. Good luck and keep us posted if you move forward with this.
