Hey guys,

We've been approached by a few people looking to import some of our products. I think that I understand the process from a legal standpoint regarding labeling and such, but I'm a bit confused on the physical act of getting it there..

Does anybody have experience in physically exporting a product to any country? Does the product for export need to be shipped from a bonded warehouse or can you ship it from your front door?

Thanks, any advice/comments are welcome!

Hey NAB...some of the challenges with exporting are related to the country you are exporting to. Each has different regulations on labeling, customs, etc. It'll depend on quanitites, but you'll probably find that the Importer will want your product in a bonded warehouse so they can consolidate a container shipment with other products.

Pop me an email if you want to discuss further.

to my understanding yes. I think that depends if you are shipping overseas or to a duty free zone though. We got a little waylaid and are currently revisiting the topic with a lawyer. Race to find the answer?

US excise Tax is not paid on exported products. A good place to start is here:

http://www.ttb.gov/itd/distilled_spirits_producer_untaxpaid.shtml

If you are thinking of exporting, it's good to go ahead and file a letterhead application, as described in circular 2004-3. Until that application is approved, you will need to file 5100.11 in advance of the export.

The distributor in each market should be able to tell you how to get compliant for that market, but some research on your end would be very beneficial.

damn. lost the lead. Thats exactly what I was looking for. I new it was tax free for Bonded and DFZ's, but had thought it delayed the Fed Excise.

so..

Can it be assumed that state excise tax is still liable, or is that only for goods sold domestically (within the state)? I don't file these paperworks, so I'm trying to figure that out.

Whiskeytango - i'm clearly not authoritative on this, but our potential importer (brazil) will be adding the labels that his country requires. I'd imagine the TTB doesn't much care how you label it, since it won't be consumed domestically. Check into JohninWV's link though. the 2004 circular didn't reference it, but there might be other gold in there.
